Please read the Notice and this website if you were employed by Wright of Florida, LLC as a Crew Lead or Flagger based in its Ocala, Florida office at any time between December 2, 2022, and the present. The Notice informs you of a collective action lawsuit seeking unpaid overtime under the Fair Labor Standards Act (“FLSA”) and describes your rights including your right to join it if you so choose.
Samantha Ortiz (“Plaintiff”) filed a lawsuit against Wright of Florida, LLC, claiming that Crew Leads and Flaggers were not paid for all hours worked, including drive time, pre- and post-shift duties, and overtime. The Lawsuit seeks unpaid overtime, liquidated damages, and attorneys’ fees and costs. Wright of Florida, LLC denies the claims and allegations in the Lawsuit and asserts that Crew Lead and Flaggers were properly paid all overtime to which they were entitled under the FLSA.
The Court presiding over this Lawsuit has not decided who is right and who is wrong in this Lawsuit, nor has the Court made any expression about the merits of Plaintiff’s claims or the strengths of Wright of Florida’s defenses.
