Basic information

1. Why did I get a notice?

The Court has decided that all Crew Leads and Flaggers who worked for Wright of Florida, LLC based in its Ocala, Florida office between December 2, 2022, and the present, should receive a notice informing them about this Lawsuit claiming unpaid overtime and their right to join it by submitting a Consent to Join form.

2. How do I join the Lawsuit?

If you wish to join the Lawsuit, you must sign, date, and return the Consent to Join form to notify the Court of your intent to join the Lawsuit as a party plaintiff. If you decide to join, you may submit your signed Consent to Join form by mailing it to:

You can also submit the Consent to Join form by email to info@OrtizWrightofFloridaNotice.com, online here or by filing it directly with the Court. To be timely, the form must be postmarked before or filed by May 26, 2026.

3. What happens if I join?

If you join the Lawsuit, unless you specify otherwise, the lawyers listed below will represent you and work with you to try to obtain overtime wages and other damages you may be owed. You will be bound by the Court’s judgment, whether it is favorable or unfavorable, on all issues, including settlement. You may also be required to provide responses to written requests from Wright of Florida, LLC, sit for a deposition, and/or appear at trial.

The attorneys representing the Plaintiffs are being paid on a contingency fee basis. If there is no recovery, you will not have to pay any attorneys’ fees and you will not owe Plaintiffs’ counsel anything. However, Wright of Florida, LLC may seek to recover its costs (but not attorney fees) from you and other individuals who opt-in to the Lawsuit. If there is a recovery, the Plaintiffs’ attorneys will receive a part of any settlement obtained or money judgment entered in Plaintiffs’ favor as determined by the Court. If you prefer, you may be represented by your own counsel, at your own expense, or you may proceed without counsel. The Plaintiffs’ counsel are:

Alternatively, you may represent yourself in this Lawsuit or designate a separate attorney to represent you in this case at your own expense. You will be solely responsible for any attorneys’ fees or costs incurred by any attorney you so designate.

4. And if I don’t join?

If you do not join, you will not be bound by any judgment entered or settlement approved by the Court in this Lawsuit. You will not be entitled to share in any amounts that might be recovered in this Lawsuit, and you will retain the right to bring your own claims. You should be aware that your time to bring FLSA claims is limited by a two or three-year statute of limitations.

5. If I am still employeed by Wright Of Florida, Llc, will my participation affect my employment?

The FLSA prohibits employers from firing, or in any way, retaliating against you because you have joined this Lawsuit. However, participating in this Lawsuit does not excuse you from complying with Wright of Florida, LLC's existing policies and work rules.
